The website, www.binaryinfra.in (“Site”) is an electronic web based platform acting in the capacity of a search engine or advertising agency only, for exchanging, exploring and enhancing business online for real estate, housing and property in India. It is owned and managed by Binary Infra (“Partnership Firm”) with its registered office at Second Floor, Plot no.B-4, Sector 6, Noida Gautam Buddha Nagar, Uttar Pradesh (201301).

The following Terms & Conditions apply to all uses of this website and are acknowledged and accepted by doing so (“Terms”). Before using any of the services offered by the Site, it is required for all Users to have read the following Terms attentively, completely understand them, and agree to them in full (“Services”).

Only those people, businesses, or organizations who are able to enter into legally enforceable contracts under Indian law are eligible to use the Services. By publishing the revised terms on this website, Binary Infra is free to change these terms of use at any moment. Upon being posted on this website, the revised version will automatically become operative.

  1. The intending Allottee(s)/ Buyer(s), has applied for the registration of Plot / Farm House/Villa with full knowledge and subject to all laws, notifications and rules applied to this area, which have been explained by the company and understood him/her.

       2. The intending Allottee(s)/ Buyer(s) has fully satisfied himself about the interest and in respect of it and there will be no investigation or objection by the intending Allottee(s)/Buyer(s) in this regards.

  1. For preferentially situated Plot /Farm House/Villa extra charges as applicable will be payable by intending Allottee(s)/Buyer(s).
  2. The intending Allottee(s)/ Buyers(s) is entitled to get the name of his/her legal heirs substituted in his/her place with the prior approval of the company, who may at its sole discretion permit the same on such conditions as it may deem fit.
  1. The timely payment of the instalment shall be essence of this Agreement(s)/Buyer(s) to comply with the terms of payment & other terms & conditions of allotment and sales. In case the Instalment is delayed, the intending Allottee(s)/ Buyers(s) shall pay interest calculated from due date of outstanding amount, @ 24% per annum, compounded at time of every succeeding instalment even then, if the intending Allottee(s)/Buyers(s) fails to pay the instalment with interest, the company shall forfeit the amount paid by him/her for the plot/Farm House/Villa and the allotment if made shall stand cancelled and he/she shall be left with no lien on his plot/Farm House/Villa.
  2. All taxes whether levied of levied in future on the land and/or on the Plot/ Farm House/Villa (as the case May be) shall henceforth be borne by the intending Allottee(s)/Buyers(s).
  3. The intending Allottee(s)/Buyers(s) shall get his/her complete address registered with the Company at the time of booked. It shall be his/her responsibility to inform the Company by registered A/D letter about all subsequent charges if any, in his/her address, failing which all demand notices and letters posted at the first registered address will deemed to have been received by him/her at the time when those should ordinarily reach such address. The intending Allottee(s) / Buyers(s) shall be responsible for any default in payment and to consequences that might occur therefrom.
  4. The Allottee(s)/ Buyers(s) shall comply with all the Legal requirements for purchase of immovable property, whenever applicable, after execution of the registration agreement herein and sign all applicable, forms, affidavits, undertaking etc., for the said purchase. This includes in particular the requirements of section 269 DC of the Income Tax ACT if so applicable, sign the form 37(1) as and when required by the developer(s).
  5. Jewar Court alone shall have jurisdiction in matters concerning this transaction.
  6. All layout plan will be as per rules and regulations of the competent authority.
  7. The amount, if any paid over and above the registration amount shall be refunded without any interest by the vendors after adjustment of interest on delayed payments and deduction of administrative expenses @ 25% of total sale consideration paid by the Allottee(s)/Buyers(s).
  8. The Allottee(s)/Buyers(s) here by agrees that in case of cancellation of booking of plot, he/she shall submit “No Objection Certificate” from the concerned dealer, if any, in this regard.

  • If the booking for any reason is withdrawn/cancelled by the applicant/allottee, then 15% of the Total Sale Price of Plots/Villas/ Farms/ Shops/Flats will be forfeited and balance amount, if any, will be refunded without any interest after deducting late payment interest or penalty on installment.
  • Druggies are explosively advised to singly corroborate the authenticity of any Pre-Launch offers entered by them.
